GENERAL TERMS AND CONDITIONS

1. Scope
These Terms govern the contractual relationship between DistriLatina Switzerland (“Seller”) and the customer for orders placed via the online store.
2. Conclusion of contract
The presentation of products does not constitute a legally binding offer.
The contract is concluded upon order confirmation by email.
The Seller reserves the right to refuse orders without stating reasons.
3. Contract language and storage
The contract language is the language selected during checkout.
The contract text is not stored after conclusion of the contract. The customer is responsible for retaining the order confirmation.
4. Prices and payment
All prices are stated in CHF and include applicable taxes unless otherwise indicated.
In case of payment default, the Seller may claim statutory default interest under Swiss law and suspend pending deliveries.
5. Delivery and transfer of risk (Art. 185 CO)
The published Shipping Policy applies.
For shipment contracts, risk transfers when the goods are handed over to the carrier unless otherwise agreed.
For store pickup, risk transfers upon physical handover.
6. Retention of title
The goods remain the property of the Seller until full payment has been received.
The Seller is entitled to register the retention of title in the appropriate register.
7. Warranty (Art. 197 et seq. CO)
The statutory warranty provisions apply.
The customer must inspect goods immediately and notify defects without delay (Art. 201 CO).
8. Frozen products and cold chain
Frozen or refrigerated products must be stored according to manufacturer instructions.
The customer must immediately verify the integrity of the cold chain upon receipt.
The Seller shall not be liable for damage resulting from improper storage or interruption of the cold chain attributable to the customer.
9. Limitation of liability
Liability is limited to intent or gross negligence to the extent permitted by law.
Liability for indirect damages, loss of profit or consequential damages is excluded.
10. Data protection (revDSG)
Personal data is processed in accordance with the revised Swiss Data Protection Act (revDSG).
DistriLatina Switzerland is the data controller. Further details are provided in the Privacy Policy.
11. Severability
If any provision is invalid, the remaining provisions remain unaffected.
12. Applicable law and jurisdiction
Swiss law applies exclusively.
Jurisdiction is determined in accordance with statutory provisions.
